Terms of Service — ReStockly

1. Overview

ReStockly ("the App", "Service") is a software application that enables BigCommerce merchants to collect customer subscriptions for out-of-stock products and automatically notify customers when products are restocked.

The Service is operated by Finten Space ("Company", "we", "us", "our").

By installing, accessing, or using ReStockly, you agree to these Terms of Service.

If you do not agree to these Terms, you must not use the Service.

2. Eligible Use

To use ReStockly, you must:

  • Be at least 18 years old
  • Have legal authority to enter into binding agreements
  • Own or operate a valid BigCommerce store
  • Comply with all applicable laws, regulations, and BigCommerce platform policies

You are responsible for ensuring your use of ReStockly complies with all consumer communication and data protection laws applicable in your jurisdiction.

3. Service Description

ReStockly provides functionality that allows merchants to:

  • Replace or enhance the default "Out of Stock" experience
  • Collect customer email subscriptions for unavailable products
  • Automatically notify customers when products or variants are restocked
  • View subscription metrics inside the admin dashboard

Features and limits may vary depending on the selected subscription plan.

We reserve the right to modify, add, or remove features as the Service evolves.

4. User Responsibilities

By using ReStockly, you agree that you will not:

  • Use the Service to send spam or unsolicited communications
  • Collect customer emails without proper disclosure or consent
  • Violate BigCommerce policies or applicable consumer protection laws
  • Attempt to reverse engineer, exploit, or interfere with the App
  • Exceed usage limits associated with your subscription plan

You are solely responsible for the content of all customer communications sent through your store.

5. Customer Communications & Notifications

ReStockly sends notifications only when a customer has explicitly subscribed to receive restock alerts.

You acknowledge that:

  • Notification delivery depends on third-party email providers
  • We cannot guarantee delivery to all inboxes
  • Customers may unsubscribe at any time using links provided in emails

The Company is not responsible for failed delivery caused by email provider filtering, customer email settings, or incorrect email addresses.

6. Subscription Billing

Paid subscriptions are billed on a recurring basis through Paddle or another authorized billing provider.

By subscribing, you authorize recurring charges according to your selected plan.

Billing terms:

  • Prices are listed in USD
  • Subscriptions renew automatically unless canceled
  • Fees are non-refundable except as outlined in the Refund Policy

7. Cancellation

You may cancel your subscription at any time via:

  • The Paddle customer portal
  • The ReStockly application dashboard

Upon cancellation:

  • Your plan remains active until the end of the current billing cycle
  • No future charges will occur
  • Cancellation does not automatically result in a refund

8. Refunds

Refunds are governed by the ReStockly Refund Policy and Paddle's Buyer Protection terms.

9. Data & Privacy

Your use of the Service is subject to our Privacy Policy, which explains how merchant and customer data is collected, stored, and processed.

You are responsible for ensuring your store's privacy policy discloses the use of ReStockly to collect customer email subscriptions.

10. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for:

  • Lost revenue or profits
  • Loss of customer data
  • Missed sales opportunities
  • Failed or delayed notification delivery
  • Business interruption or reputational damage

Our total liability shall not exceed the amount paid by you for the Service in the previous 30 days.

11. Modifications to the Terms

We may update these Terms from time to time.

Continued use of ReStockly after changes are published constitutes acceptance of the updated Terms.
